Terms & Conditions

These Terms & Conditions ("Terms") govern your use of the Aussie Concrete Pumpers website and ACP platform operated by Hazelton Building Contractors Pty Ltd ABN 91 612 377 616 ("Aussie Concrete Pumpers", "we", "us"). By accessing or using the Platform, you agree to these Terms. If you do not agree, do not use the Platform.

Aussie Concrete Pumpers operates an online marketplace that connects concrete pump operators ("Operators") with builders, concreters, and project managers ("Customers") seeking concrete pumping services. We also provide a supplier directory ("Spares, Sales & Service") connecting trade suppliers with Operators.

We are a platform intermediary only. We do not provide concrete pumping services ourselves. Contracts for concrete pumping services are formed directly between Customers and Operators.

• You must be 18 years or older and have legal capacity to enter into contracts to create an account.
• You must provide accurate and complete information when registering.
• You are responsible for maintaining the confidentiality of your account credentials.
• You must notify us immediately of any unauthorised use of your account.
• We may suspend or terminate accounts that breach these Terms.

• Customers may use the Platform to search for Operators and submit booking requests free of charge.
• Submitting a booking request does not constitute a confirmed booking. A booking is confirmed only when an Operator accepts the request.
• A Priority Dispatch surcharge of $100 AUD (inc. GST) applies where the Customer selects the Priority Dispatch option. This fee is non-refundable once an Operator has been confirmed.
• Customers are responsible for ensuring accurate job details are provided, including postcode, pour volume, access requirements, and job date.
• Customers deal directly with Operators for pricing, invoicing, and payment. Aussie Concrete Pumpers is not a party to those transactions.

• Operators must hold a valid ABN and all licences, registrations, and insurances required by law to provide concrete pumping services in their jurisdiction.
• Operators must maintain current public liability insurance at all times while listed on the Platform. Minimum coverage: $10 million.
• Operators must keep their profile information accurate and up to date, including service regions, pump types, and availability.
• Operators must respond to leads within their applicable acceptance window (Bronze: 24 hours; Silver: 2 hours; Gold: 3 hours; Platinum: 4 hours).
• Operators must not contact customers obtained through the Platform outside the Platform for purposes of circumventing Platform fees.
• Operators are solely responsible for the quality, safety, and legality of the services they provide.

• Operator membership fees are charged monthly or annually as selected at sign-up.
• Bronze members are charged a base membership fee plus a $25 per-lead fee for each lead accepted. Lead fees are billed at the end of each calendar month.
• Annual memberships are discounted at approximately 15–17% compared to monthly billing. Annual fees are non-refundable after the 14-day cooling-off period.
• Unclaimed profiles that have been claimed are free until the Operator accepts their first job through the Platform. Billing activates at the end of the billing month in which the first job is accepted.
• We reserve the right to update membership pricing with 30 days' written notice to affected members.
• All prices are in Australian Dollars (AUD) and inclusive of GST where applicable.
• Payment is processed by Stripe. By providing payment details, you agree to Stripe's Terms of Service.
• Failed payments may result in account suspension until the outstanding amount is resolved.

• Monthly memberships may be cancelled at any time. Cancellation takes effect at the end of the current billing period. No partial refunds are issued for the remaining billing period.
• Annual memberships may be cancelled within 14 days of the billing date for a full refund ("cooling-off period"). After 14 days, annual fees are non-refundable.
• Platinum territory memberships require a minimum 12-month commitment. Early termination does not entitle the Operator to a refund of remaining months.
• Lead fees already incurred are non-refundable.
• Refund requests must be submitted to privacy@aussieconcretepumpers.com.au within the applicable period.

You must not use the Platform to:

• Post false, misleading, or fraudulent information
• Impersonate another person or business
• Circumvent platform fees or introduce customers and operators outside the Platform
• Harass, threaten, or abuse other users
• Violate any applicable law or regulation
• Upload malicious code or interfere with Platform operation

• Reviews must be honest, accurate, and based on genuine experience.
• We reserve the right to remove reviews that are defamatory, false, or in breach of these Terms.
• Operators must not offer incentives in exchange for positive reviews.

• All content on the Platform (excluding user-submitted content) is owned by or licensed to Aussie Concrete Pumpers.
• You may not reproduce, distribute, or create derivative works from Platform content without written permission.
• By submitting content to the Platform (photos, descriptions, reviews), you grant us a non-exclusive, royalty-free licence to use that content for Platform operation and marketing purposes.

• To the maximum extent permitted by law, Aussie Concrete Pumpers excludes all liability for loss or damage arising from use of the Platform, including loss of profits, data, or business opportunity.
• We are not liable for the quality, safety, or legality of services provided by Operators.
• We are not liable for the accuracy of Operator or Supplier profile information.
• Our total liability to you for any claim is limited to the fees you paid to us in the 3 months preceding the claim.
• Nothing in these Terms excludes liability that cannot be excluded under the Australian Consumer Law.

Certain guarantees apply under the Australian Consumer Law that cannot be excluded. Nothing in these Terms is intended to exclude, restrict, or modify any right or remedy you may have under the Australian Consumer Law.

• If a dispute arises between a Customer and an Operator, the parties must attempt to resolve it directly in the first instance.
• We may, at our discretion, assist in facilitating resolution but are not obligated to do so and are not liable for the outcome.
• For disputes between you and Aussie Concrete Pumpers, please contact us at privacy@aussieconcretepumpers.com.au. If unresolved within 30 days, either party may pursue resolution through the relevant dispute resolution body.

These Terms are governed by the laws of New South Wales, Australia. You submit to the non-exclusive jurisdiction of the courts of New South Wales.

We may update these Terms at any time. Material changes will be notified to registered users by email with 14 days' notice. Continued use of the Platform after changes take effect constitutes acceptance.
